TERMS AND CONDITIONS

THIS AGREEMENT

1.1 These Terms and Conditions (hereinafter referred to as “Terms and Conditions” comprise the terms and conditions of your use of the GaaSuper6 service provided in whatever form on this Application (the “Application”) or this Website (the “Website”) (as the case may be) and through whatever delivery mechanism offered. They constitute your agreement with us and apply to the exclusion of any other terms that you seek to impose or incorporate or which are implied by trade, custom, practice or course of dealing.

1.2 Any references to “Terms and Conditions” include these Terms and Conditions and the privacy policy. To the extent that there is any inconsistency between these Terms and Conditions and the Privacy Policy, these Terms and Conditions shall prevail.

1.3 GAASuper6 is owned by Sports Fundraising Limited, a registered Irish Company, with registered offices at 18 Inns Court, Winetavern Street, Dublin 2 Registered No: 576573. Sports Fundraising holds a Remote Bookmakers License. License Number: 1011466.

1.4 In these Terms and Conditions, Sports Fundraising Limited is referred as “Sports Fundraising”, “we”, “us” or “our” and you are referred to as “member”, “you”, “player” or “your”.

1.5 These Terms and Conditions come into force immediately upon acceptance by you, indicating that you agree with and accept to be bound by its terms. You are advised to read these Terms and Conditions carefully. Your continued use of the Application and/or Website means that you accept these Terms and Conditions, which form a binding legal agreement between you and Sports Fundraising. If you do not agree to be bound by them, you should exit the Application and/or the Website immediately.

2. AMENDMENTS TO THIS AGREEMENT

2.1 We reserve the right to revise or amend the Terms and Conditions at any time. Any amendments will be effective immediately on the earlier of (a) its posting on the Application and/or the Website or notifications to you by email. If you disagree with any such revision or amendment, you should cease using the Application and/or the Website immediately. We recommend that you check the Application and/or the Website from time to time to review these Terms and Conditions because they are binding on you.

2.2 No customer service operative has the power to amend these Terms and Conditions.

3. PLAYER ACCOUNT INFORMATION

3.1 You are required to enter all mandatory information requested by us. We shall not be liable for incorrect entries, including but not limited to data input error.

3.2 You must be over the age of 18 (eighteen) to register and open an account with us, and by doing so, you warrant to us that you are that age or over and that all information that you provide to us is, to the best of your knowledge and belief, accurate and complete and that any future changes to this information will be provided to us in a timely manner. We reserve the right to request proof of age documentation from any customer at any time.

3.3 You shall fulfill all commitments made on your account in the course of using the Application and/or the Website and are fully responsible for all communications from your account, and for anyone using your account. You agree that if any other person uses the Application and/or the Website through your account, you shall be bound by such use as if it were your own use, and you shall fully indemnify us in respect of any failure by such third party to fulfill any commitments made by such use.

3.4 Every member will choose their confidential login information. For security reasons we recommend members change their login information from time to time. It is your responsibility to keep this information securely, as all transactions where login information is used, will be regarded as valid.

3.5 For members using the Application, please note that we will not be responsible for any damage to, or loss of data from mobile phones on which the data is installed, or for any call charges incurred while using the Application. Please note that using the Application outside a Wi-Fi network may result in data charges from mobile network providers. We will not be responsible for any such charges.

3.6 You agree that any information provided through your account, including names, email addresses and phone numbers will be accurate, and that you will update that information promptly when it changes. It is your responsibility to ensure that all personal details are current and up to date as failure to do so may result in transactions/payments being incorrect. You acknowledge that if any of the information is inaccurate, we reserve the right to terminate your account, this agreement and the use of the Application and/or the Website.

3.7 You agree that we may use personal information provided by you in order to conduct anti-fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.

3.8 Employees of Sports Fundraising Ltd, GAASuper6, their relatives, agents or agents' relatives are not eligible to win prizes.

3.9 Participation of minors in offered on this website activities is prohibited.

3A. THE COMPETITION

3A.1 Registering: Upon registration you will be asked to enter your email address, nickname (this is the name which will be displayed on leaderboard), and check the box accepting our terms and conditions to confirm that you are over 18 years of age to form a binding contract and are not a person barred/restricted from receiving services under the laws of any applicable jurisdiction.

3A.2 If logging in with your Twitter or Facebook ID, you will need to select ok confirming you are over 18 years of age and accept our terms and conditions. (Your email address from this login will be used as your nickname, and you can update your nickname within the edit profile section once logged in) - e.g ([email protected] - test123 will be displayed as your nickname)

3A.3 The player will predict scores from 6 selected GAA matches. (Depending on fixtures and/or postponements there maybe less than 6 matches in a game week).

3A.4 The player will have the option to select one of the matches to earn Double Points. This is indicated in the furthest right hand column, with the heading DP. By default the 1st match will be selected as Double Point match if the player doesn’t make a selection.

3A.5 The Player is limited to a maximum of 7 plays per game week. Each prediction entered will have your nickname displayed, and will append by 1 if you enter more than one prediction. E.G The first prediction you enter will display on leaderboard with nickname winningname_1. If you enter more than one prediction, they will be displayed as winningname_2, winningname_3 etc…

3A.6 Once predictions are submitted and payment is made scores are unable to be modified.

3A.7 The €2 entry fee (excluding Mobile operator additional charges charges) that the user pays per prediction they submit, 20% of all monies entered go back to the nominated GAA club.

3A.7b Free Entry option (running for a period of time only). Each user is allowed to submit one free entry per gameweek as long as the option is presented to the user within the payment flow. Sports Fundraising LTD can decide at anytime to remove this option.

3A.7c Free Entry Option: The free entry that is submitted, does not provide the users club with 20% of the entry fee as the entry submitted was free. Any entries that the user has paid for will have 20% of those entries paid to their nominated club. (As per section 3A.7 of our terms and conditions).

3A.7d Free Entry Option: Anyone found to use multiple accounts to enter will be ineligible. Fraudulent activities will be monitored and will lead to exclusion.

3A.8 To ensure that your affiliated club receives 20% of your entry fee for the game week you have entered, ensure you have updated your club/county within your ‘edit profile’ when logged in. It is each player’s sole responsibility to ensure that their club details are up to date, before the kick-off of the first game in that particular game week. If a player/s don’t have a club nominated, then the 20% of this player/s money for each prediction received will be divided between all clubs who we have listed on our ‘club leaderboard’ for that particular game week.

3A.8b All clubs registered by users will be verified with the relevant authorities.

3A.9 20% of the winners weekly pot, will go back to that winners GAA club. If there are two or more player/players who have topped the leaderboard (scoring the highest amount of points) and still tied after our scoring permutation split (see section 3A.13) then the weekly pot will be split equally among those players.

3A.9.1 It is each player’s sole responsibility to ensure that their club details are up to date, before the kick-off of the first game in that particular game week. In the event that a winner has no club updated within their profile, then Sports Fundraising LTD will request the winner to nominate a GAA club within their county for that particular game week.

3A.10 80% of the weekly pot will go to the winner. If there are two or more player/players who have topped the leaderboard (scoring the highest amount of points) and still tied after our scoring permutation split (see section 3A.13) then the weekly pot will be split equally among those players. See section 4.14 for additional information on winning, and receiving payment.

3A.10.b 80% of the bonus pot will go the player(s) who correctly predict 4 scores, with 20% going to the winner(s) club. If more than one player predicts 4 correct scores in that gameweek, then the pot will be split equally between these player/players. See section 4.1.a for additional information on winning.

3A.11 Clubs will be paid once a year, provisionally October/November (in conjunction with our game year ending), and we need to ensure that all players have entered their club/county details to ensure the correct allocation is being distributed to your GAA club. It is each player's sole responsibility to ensure that all details are up to date.

3A.11b Our game year is October to September, funds raised from October onwards are included in the new game year.

3A.12 The competition for each game week will close at the kick-off time of the first match in that game week. All entries will required to be submitted before that kick-off time to be entered into that game week.

3A.13 Points will be scored as follows: Scoring Only applies if Correct Result predicted. Players will receive 2 points for Correct result. Additional points are then added depending on the results you have predicted.
6 points if the correct score is predicted for Team A
6 points if the correct score is predicted for Team B
3 points for the correct cumulative Score for Team A
3 points for the correct cumulative Score for Team B
1 point if you are within 3 points of Team A score
1 point if you are within 3 points of Team B score
Maximum Total points if correctly predicting Team A & Team B scores in 1 match is 20 points that you will receive. If this match is chosen as Double-Points (DP) option, total score for this match is 40 points.
If correct Score is predicted in all 6 GAA matches total points is 120 + 20 (DP) = 140 points is the maximum one player can score.
Player standings in the leaderboard are as follows: Correct Result, then Correct Score, then Correct Cumulative Score. If more than one user still tied, the tie breaker question will be used, to determine the winner/s.
Tie Breaker explained : Total number of Goals scored in all 6 matches is checked against total number of goals predicted. If total not guessed correctly, then whoever is closest + or - will be deeemed the winner. If more than one person correct, then these people will be the winner. Total goals for the games predicted will be calculated automatically (displayed as TBG on leaderboard) and can be manually changed if required before predictions are submitted.

3A.14 Fixture scores are verified from rte.ie and gaa.ie. For club games, fixture scores are verified from each of the counties official gaa website. This data will be used to determine final leaderboard positions and winners of all prizes.

4. Fees and Payments

4.1 Sports Fundraising Ltd has agreed with each player registered on this website (gaasuper6.com) that 80% of the total pot raised will be distributed to the player who tops the leaderboard (Scoring the highest number of points, and top after player standings - see section 3A.13) of that gameweek, with 20% going to the winner’s nominated club of that gameweek. Also 20% of all monies entered going to player’s nominated clubs who have entered for that prediciton gameweek only. If there are two or more player/players who have topped the leaderboard (scoring the highest amount of points) and still tied after our scoring permutation split (see section 3A.13) then the weekly pot will be split equally among those players.

4.1.a Bonus Pot: The bonus pot prize is €5,000 unless otherwise specified. This bonus pot is awarded to the player/players who correclty predicts the scores in FOUR of the SIX fixtures in a relevant gameweek. If there are two or more player/players who have correctly predicted the scores of FOUR of the SIX fixutures, the bonus pot will be split equally amongst those players.

4.1.b FOUR correct scores are determined as follows: Team A v Team B. If the score of Team A and the score of Team B, goals and points are correct this is ONE correct score. No other permutations will be accepted as a correct score. Sports Fundraising LTD decision in determining a correct score is final.

4.2 You may only make payment by using one of the available payment methods on the Application and/or the Website.

4.3 Depending on your chosen payment method, fees may be payable by you and will be treated as an independent charge by the relevant payment provider, for which you will be fully responsible. These payment fees will be made clear to you when payment is being proccessed with your account.

4.4 Players making payment by visa/master card, and/or mobile hereby agree that all information supplied is true correct and complete. The person making the payment is duly autorized to use visa/master card, and/or mobile number for that purpose.

4.4a Internet gambling may be illegal in the jurisdiction in which you are located; if so, you are not authorized to use your payment card to complete this transaction.

4.4b Cardholder's responsibility to know the laws concerning online gambling in his or her country of domicile.

4.4c The cardholder must retain a copy of transaction records and Merchant policies and rules.

4.5 Should your visa/master card details and/or mobile device be lost or stolen you should inform us as well as the bank and/or mobile operator immediately, and if necessary the Gardai or police.

4.6 All payments made via the Application and/or Website are final unless fraudulent use of card account/mobile is proven in accordance with clauses 4.4, 4.5.

4.7 Please note the payment amount for each prediction is €2, with Sports Fundraising incorporating our payments company processing charges if making payment by visa/master card. (varies if payment made by mobile number – see 4.8) and the maximum amount of entries you can have per player login is 7.

4.8 When using your mobile phone for payment, processing company charges are applied. (Vodafone / 3 / Meteor / Eir).

4.9 Mobile payments can only be accepted by customers in the Republic of Ireland.

4.12 All winning payments will be processed as soon as practical by Sports Fundraising Limited and the processing bank. You acknowledge that in the absence of fraud, you shall not have any right of cancellation of your prediciton fee/s and in placing a payment, you waive any statuory rights you may have to cancellation of the processing of your payment by Sports Fundraising.

4.13 All winning payments will be made in Euro by way of bank transfer. The processing bank may charge a processing fee, which is not incurred by Sports Fundraising.

4.14 Winners will be notified by email. It is each player’s sole responsibility to ensure that their contact details are up to date. These can be updated within the 'edit profile' page when logged in. Winners will be required to verify (with evidence satisfactory to Sports Fundraising LTD) their age, identity, residence and other requested verification information to the satisfaction of Sports Fundraising LTD before they are eligible to receive any winnings/prizes.

4.15 Entry and participation constitutes permission for Sports Fundraising Ltd and/or its associated, affiliated ansd subsidiary companies to use the names, predictions and photographs of participants for publishing purposes at its discretion, including but not limited to leaderboards and other display within the GAASuper6 Website or related applications. All winners may be required to participate in such publicity as Sports Fundraising LTD reasonably requires.

4.16 If any player is not able, for whatever reason, to provide satisfactory verification information to the satisfaction of Sports Fundraising LTD, has been found to have breached these terms and conditions by Sports Fundraising LTD, or cannot be contacted within five (5) business days of final leaderboard standings being displayed, then that player will be disqualified and the pot/winnings/prize will be awarded to another player. If more than one winner in that particular game week, then the player who is disqualified, their winnings will be divided between the remaining winners for that game week. If only one winner in that game week, then the player/s who are next in the leaderboard within that game week will be deemed the winner/s, and will receive the pot amount for that game week.

4.17 Any announcement of winners on GAASuper6 (Online, Twitter, FB etc.) is pending verification and is not final confirmation.

4.18 Should any winnings be credited/debited to your account in error, it is your responsibility to notify us without delay.

4.19 As highlighted in section 3A.11 all clubs will receive funds in October/November. To verify details of payment with affiliated clubs all correspondence must be completed by the Club Secretary or Treasurer using the official GAA.IE email address. Additional confirmation and checks where applicable maybe required.

SMS service

5.1 On the Website you can opt to pay using your mobile number. You will receive a short service message (SMS) notification to the mobile phone number that you nominate when making the request in respect of your bet on the Website in which you have an interest for your own personal use (the “ SMS Service”), and this service forms part of the Sports Fundraising Service.

5.2 You agree and acknowledge that the SMS messages are distributed by third party mobile phone network providers and, for that reason the SMS Service and timeliness of information may be impacted by factors associated with the player’s mobile phone network provider which are outside of our control. You agree and acknowledge that we are not liable for SMS message transmission delays, issues or failures. You agree and acknowledge that network delays, poor network coverage, your mobile device being switched off, your message inbox being full and/or your mobile device having inadequate memory or power may prevent or inhibit you receiving the SMS Service.

5.3 The information provided through the SMS Service indicates that a bet matching the criteria that you have submitted on the Website has appeared on the Website. We do not guarantee the availability, accuracy or completeness of the information provided pursuant to the SMS Service. We accept no responsibility for: (i) any loss of profits, loss of earnings, loss of anticipated savings, loss of goodwill or loss of revenue; or (ii) any indirect or consequential loss suffered due to the delay, inaccuracy or other failure of the information provided to the you pursuant to the SMS Service or otherwise.

5.4 We reserve the right to amend, alter or terminate the SMS Service at any time with or without notice to you.

DORMANT ACCOUNTS

6.1 For the purposes of these Terms and Conditions, a “Dormant Account” shall mean any customer account which, for a continuous period of 12 (twelve) months or more, has not (a) not entered a prediction week; or (b) had a bet accepted from it.

6.2 If your account has been deemed a Dormant Account and has subsequently been dormant for an additional 12 (twelve) calendar months, your account shall be deemed to be an “Abandoned Account” and closed, and any winnings due to you that have not been claimed will be donated to your nominated club or charity.

6.3 Suspended Accounts will also be placed into the dormant category after 12 months from the date the account was suspended or self-excluded.

CLOSING YOUR ACCOUNT

7.1 You have the right to close your account at any time. To close an account you must email us [email protected] On receipt of your email, we will respond within a reasonable time confirming closure of your account but you will continue to be responsible for all activity on your account until such time as closure of your account has been confirmed to you by us.

7.2 Should you decide to close your account, all competitions that you are involved in will hold your entry fee for that competition week, and any additional competition weeks that you have recurring payments configured for, we will remove you from those compeition weeks, cancelling your profile. You will require to confirm with your payment provider that these recurring payments have been cancelled on their side also.

ACCOUNT SUSPENSION

8.1 Sports Fundraising may terminate Your registration with the Website or your use of the Website on written notice (which shall include e-mail) if You are in breach of any of the terms and conditions of this Website and fail to correct such breach within fourteen (14) days following adequate notice from Sports Fundraising specifying the breach, Sports Fundraising may terminate forthwith without notice.

8.2 In the event of the use of the site being terminated for any Player, that Player will still be bound by the terms and conditions of the site in all matters relating to the site.

8.3 Termination of these terms and conditions for any reason shall not affect the accrued rights of the parties.

PRIVACY AND SECURITY POLICY

9.1 Sports Fundraising privacy and security policy forms part of the terms and conditions of this site., and acceptance of these terms and conditions assumes acceptance of the privacy and security policy.

9.2 The privacy and security policy is worded in separate document from these terms and conditions, and should be viewed by viewing the privacy statement page on this site. By using this Application and/or Website and/or participating in any competition, you hereby confirm that you are agreeable to Sports Fundraising privacy and security policy.

CHANGES TO THESE TERMS AND CONDITIONS

10.1 Sports Fundraising reserves the right at any time from time to time to modify or discontinue, temporarily or permanently the website with or without notice. You agree that Sports Fundraising shall not be liable to You or any third party for any modification, suspension or discontinuation of the Service. Sports Fundraising will communicate via email with all active players any changes to the T&C’s.

10.2 Every time You use the site You are deemed to have understood and accepted the latest terms and conditions as published at the time.

10.3 Any changes made to any terms and conditions of the Sports Fundraising website will be notified to each customer by email when such changes are made.

10.4 Any player who fails to comply in any way with these terms and conditions may at the sole discretion of Sports Fundraising and without prior notification, be suspended or banned altogether from the site.

10.5 Upon registration to the site and before entering a prediction a player must tick a box to confirm they have read the terms and conditions laid out.

LIABILITIES

11.1 You hereby acknowledge and accept that by using our Application and/or the Website there is a risk of losing money. We accept no responsibility, nor shall we be liable for any consequences that are alleged to have occurred through your use or misuse of the Application and/or the Website.

11.2 Every member is responsible for the information they provide. We will not enquire into the reasonableness of any predictions made, input errors, or losses incurred through misleading, inaccurate or ambiguous bet descriptions.

11.3 The Application and/or the Website is provided “as is” and without any express or implied warranty of any kind. Accordingly, to the maximum extent permitted by law, we provide you with the Application and/or the Website on the basis that we exclude all representations, warranties, conditions and any other terms (including but not limited to warranties of merchantability, non-infringement of intellectual property, or fitness for any particular purpose) which, but for these Terms and Condition might have effect in relation to the Application and/or the Website.

11.4 In no event will Sports Fundraising (or any of its group companies, officers, directors, employees, shareholders or agents) be liable for any damages whatsoever including, without limitation:

(a) any direct, indirect, special, incidental, consequential loss or damages whether exemplary or punitive;

(b) any loss of income;

(c) any loss of direct or indirect profits;

(d) any loss of goodwill;

(e) any loss of data;

(f) any loss of contracts;

(g) any loss of use of money;

(h) any loss or damages arising from or connected in any way to business interruption; or

(i) and whether in tort (including without limitation negligence), contract or otherwise in connection with the Application and/or the Website in any way or in connection with the use , any inability to use or the results of the use of the Application and/or the Website including but not limited to loss or damages due to viruses that may infect your computer equipment, mobile handset, tablet, software, data or other property on account of your access to, use of, or browsing of the Application and/or the Website or the downloading of by you of the Application.

11.5 You agree to indemnify and hold us, our officers, directors, agents, employees harmless (and keep us so indemnified or held harmless) brought against us by any third party from any liabilities, costs, claims, actions, proceedings, damages, expenses (including legal costs and expenses) losses or demands whosoever arising, suffered or incurred by us as a result of your breach of these Terms and Conditions or any documents incorporated by reference into this agreement or out of your violation of any law or the right of any third party.

11.6 We will not be liable for any loss or damage that you may suffer because of any act of God, power failure, trade or labour dispute, act, failure or omission of any government or authority, obstruction or failure of telecommunication services or networks, access delays or access interruption, data non-delivery or data mis-delivery, the unauthorised use of your security access details or any other delay or failure caused by a third party. In such an event we reserve the right to void any bet or cancel or suspend our services arising from such circumstances without incurring any liability. Furthermore, we will not be responsible for the failure of any equipment, wherever located or administered, or whether under our direct control or not, that may prevent the operation of our Application and/or the Website, or prevent you from being able to contact us.

11.7 Nothing in these Terms and Conditions shall exclude our liability which we may have in respect of fraud or death or personal injury arising from our negligence.

11.8 You acknowledge that we will hold information with respect to your identity, including, but not limited to your name, address and mobile number (if applicable). You agree that we rely on this information in entering into this agreement with you, and you accept that we have no liability whatsoever against any inaccuracy or falsehood contained in the information as provided by you.

11.9 Unless otherwise stated, we are the owners and authorised players of all intellectual property rights in all materials on the Application and/or the Website, and all its content including, without limitation, any copyright, trademarks, text, photographs, videos, logos, designs, codes, templates, specifications and any modification, improvements, enhancements thereof. These intellectual property rights are protected by the laws of Ireland, international treaties and all other applicable copyright and intellectual property laws. If you breach any of the terms of clauses, your permission to use the Application and/or the Website shall automatically terminate and you must destroy any downloaded or printed extracts from the Application and/or the Website.

11.10 Any rights not expressly granted in these Terms and Conditions are reserved. All content and materials on the Application and/or the Website are provided for your own personal usage, thus the reproduction, distribution, or commercial exploitation of such content or materials in any manner whatsoever without our express and prior written consent is prohibited. Any other use or reproduction of any such materials without our prior written consent will constitute a breach of these Terms and Conditions.

11.12 It is strictly prohibited to collect any data from us by screen scraping or any other automated or manual collection. It is also prohibited to use any data from the website without our prior written permission.

11.13 For the avoidance of any doubt, you may use the data available on the Application and/or the Website, only as strictly required for your permitted personal purpose of availing of our service. We reserves the right to take such action as we consider necessary, including issuing legal proceedings without further notice to you, in relation to any unauthorised use of our data, or of the Application and/or the Website.

11.14 We cannot allow for mistakes, nor accept responsibility for any errors or omissions in respect of the announcing, of game results. Sports Fundraising reserves the right to correct any obvious errors. Should funds credit to a customer's account in error, it is the customer's responsibility to notify Sports Fundraising of the error without delay. Sports Fundraising reserves the right to amend/correct account balances. Any winnings subsequent to the error and prior to the notification of Sports Fundraising, whether linked to the error or not, shall be deemed invalid and returned to Sports Fundraising.

CODE OF CONDUCT

12.1 This is an honour based service. Players are expected to behave in an honourable manner in all communication with one another. While using the Application and/or the Website, you agree that all the following will be considered to be inappropriate behaviour and may warrant disciplinary action including termination of your account:

(a) Transmitting or communicating any content which, in our opinion, is offensive, including language that is hurtful, offensive, harmful, threatening, abusive, harassing, obscene, vulgar, sexually explicit, unlawful, or racially, ethnically, or otherwise objectionable.

(b) Posting any inappropriate information about yourself or other members.

(c) Impersonating any person or business, or communicating in any way that makes it appear that the communication originates from Sports Fundraising.

(d) Threatening, harassing or stalking another member.

(e) Spamming chat

(f) Participating in any action which, in our opinion, exploits the Application and/or the Website in order to secure unfair advantage over other members.

(g) Participating in any action which in our opinion, defrauds any other member of the Application and/or the Website.

(h) Removing, altering or concealing any copyright, trademark, patent or other propriety rights notices of Sports Fundraising contained in the Application and/or the Website. You are also prohibited from the transmission of content that violates or infringes the rights others, including without limitation, patent, trademark, trade secret, copyright, publicity, or other proprietary rights.

(i) Using any unauthorised programmes that interact with the software in any way for any purpose, including, but not limited to intercepting, emulating, or redirecting any communication, or collecting information or reading memory used by Sports Fundraising.

(j) Uploading an inappropriate profile picture or photo.

SOFTWARE AND LINKS

13.1 By using the Application and/or the Website, you are wholly responsible for all internet connection fees, together with all equipment servicing or repair costs necessary to allow you to access the Application and/or the Website.

13.2 The Application and/or the Website contain links to other third party sites. These links are provided solely as a convenience to you and not as an endorsement by us of the content of such third party websites. Use of these links and the external websites are at your own risk. The linked websites are not under our control and therefore we accept no responsibility for the content of such websites. We hereby disclaim all liability with regard to your access to and use of such websites.

SECURITY

14.1 We follow best practice to safeguard your personal information. You accept the inherent security implications of using the internet, and therefore we cannot absolutely guarantee the security of any information you disclose.

14.2 To maintain a high level of security, we may perform random security checks on your account and keep records of transactions. In the event of a security check, we may require additional documentation and you agree to fully co-operate with us in respect of such requirements. We reserve the right to terminate and/or suspend your registration and/or account and/or withhold payment to you if we do not receive such documentation.

RESPONSIBLE BETTING

We operate a responsible betting policy including the following:

17.1 Self Excluding: If you wish to restrict your playing, you can do so by following our self-exclusion procedure in your account settings. Alternatively this facility is available by contacting [email protected] On completion of this process, we will close your account and return any outstanding winnings to you. Any outstanding competitions that are in progress shall be voided. The money will remain in the pot until the competition is complete. You can close an account or self exclude for a minimum of six months. If you elect to self-exclude, your account may not be opened or utilised during the period of self-exclusion. We will use our reasonable endeavours to ensure that we comply with your self-exclusion, but cannot accept any responsibility for any additional account unless requested at the time of the exclusion or at any subsequent time by the member. During the exclusion period all efforts will be made to exclude you from playing. However you must not attempt to join us, and we cannot be responsible or liable for any subsequent consequences or losses (howsoever caused) that you may suffer or incur if you continue gambling through additional accounts where you have altered any of your registration details or you provide misleading, inaccurate or incomplete details or otherwise seek to circumvent the self-exclusion. At the end of the self exclusion period, you may reactivate your account by contacting us at [email protected] We will not reopen any self-excluded account but, after the expiry of the exclusion period, you may telephone us to open your account. By law, we are required to provide you with a 24 hour cooling off period, during which you may elect to keep the exclusion in place.

17.2 Age Verification: It is illegal for anyone under the age of 18 to open an account or to enter a competition or gamble on Sports Fundraising. Sports Fundraising takes its responsibilities in this regard very seriously.

Should an account be suspended all funds will be frozen and the player will not be able to continue to make selections or join any further competition, whether the competition is free to play or not.

RIGHT OF REFUSAL

15.1 We reserve the right (in our sole discretion) to refuse to register you and/or to suspend and/or terminate your account at any time and/or to refuse to accept any bet or transaction in respect of or in connection with your use of the Application and/or the Website. We shall not be obliged to provide you with any reasons for so doing and shall not be liable to you in any way for any loss or damages that may result from any such action.

15.2 We reserve the right to refund to you or withhold any payment of monies to you if there is manipulation of our financial system or suspicion or evidence thereof or a breach or suspected breach of any applicable law, regulation or any of these terms and conditions, in each case without providing any reason.

15.3 Use of any account otherwise than in accordance with these Terms and Conditions or any other abuse of any account is strictly prohibited.

15.4 We reserve the right to withdraw your use of any of the Application and/or the Website at any time, subject to fulfilment of any outstanding commitments under these Terms and Conditions.

JURISDICTIONS

16.1 Persons located outside the Ireland are prohibited from using the Application and/or the Website. This prohibition may be changed by us from time to time with or without notice.

16.2 The presentation by us of any competitions does not constitute an offer or invitation for the use of the Application and/or the Website in any jurisdiction outside Ireland.

16.3 It is your responsibility to fully and completely comply with laws concerning betting in the jurisdiction in which you are located. If you live in a country which prohibits betting you must not register with us, or attempt to use our services.

16.4 Accessibility of the Website in any jurisdiction outside of Ireland shall not be construed as a representation or warranty with respect to the legality of use of the Application and/or the Website in that jurisdiction. No winnings shall be paid to you in respect of the use of the Application and/or the Website whilst you are located outside Ireland.

16.5 We reserve the right to terminate your account and refuse any and all current or future use of the Application and/or the Website if we suspect or know that you have been using them whilst located outside of Ireland.

COMPLAINTS PROCEDURE

17.1 Sports Fundraising will do its best to resolve any complaints. If you have a complaint or a dispute, please email [email protected] We will attempt to respond to all emails within 24 hours during Helpdesk hours. The Helpdesk is open 9:30am to 5:30pm Mon–Fri. Any complaints should be submitted within 30 (thirty) days of when the event in question took place. Sports Fundraising declines all responsibility for any claims received after this time.

17.2 Should there be any claim or dispute relating to any competition, please contact us. We will be happy to assist you. If we are unable to settle the dispute, we will refer the dispute to the Independent Betting Adjudication Service (IBAS).

17.3 The arbiter’s decision will be final (save in respect of any manifest error) subject to full representation being given to all parties involved.

Notwithstanding Clauses 17.1., 17.2 and 17.3, SPORTS FUNDRAISING LTD reserves the right to take legal action against any party in breach of these Terms of Use, at its election, in Ireland or the place of breach or the domicile of that party, and that party shall submit to the jurisdiction chosen by SPORTS FUNDRAISING LTD.
